Parent Portal User

In addition to the terms as a General visitor, the following terms will also apply if you sign up to our Parent Portal services as the parent of a child that has asked to sign up to a website or a mobile app that is a member of our Kids Web Services programme.

BY CLICKING ON THE “YES” OR “I ACCEPT” BUTTON (OR OTHER BUTTON OR MECHANISM DESIGNED TO ACKNOWLEDGE AGREEMENT TO THESE TERMS), OR BY ACCESSING OR USING THE PARENT PORTAL, YOU ARE CONSENTING TO BE BOUND BY THESE TERMS.

If you have registered as a publisher to use the Kids Web Services platform, you will also be bound by your KWS licence agreement if you have signed one.

Licence: Subject to these terms, SuperAwesome grants you a limited, royalty-free, personal, non-exclusive, non-transferable, non-sublicensable licence to use the Parent Portal, through which you can register, manage and check-in on your child’s activity and information on the sites and apps that operate on our Kids Webs Services Platform (“Licence”). The Licence shall commence on the date on which you access KWS Self-Serve and continue until an end-date designated by SuperAwesome in its sole discretion (“Licence Term”).

Account Security: When creating your account, you must provide accurate and complete information.  For details of what information we may collect and how we use such information, please consult our Privacy Policy. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure.  You must notify SuperAwesome immediately of any breach of security or unauthorized use of your account. Although SuperAwesome will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of SuperAwesome or others due to such unauthorized use.

Restrictions: Unless these Terms of Use state otherwise, you will not: (a) permit others to access or use Parent Portal at any time without SuperAwesome’s prior written consent; (b) modify, correct, adapt, translate, enhance or prepare derivative works or improvements of the Parent Portal; (c) reverse engineer, disassemble, decompile, decode, adapt or otherwise attempt to derive or gain access to the Parent Portal’s source code, in whole or in part; (d) rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer or otherwise make available the Parent Portal to any person; or (e) access or use the Parent Portal for purposes of competitive analysis or any other purpose that is to SuperAwesome’s detriment or commercial disadvantage.

IP Rights: Except for the above Licence, SuperAwesome reserves and retains all right, title and interest including without limitation all intellectual property rights, patents, copyright or trademarks (“Rights”) in and to the Parent Portal and Kids Web Services and nothing in these Terms of Use grants you or any third party any Rights in or to the Parent Portal or Kids Web Services. You will not remove any copyright and other intellectual property rights notices contained in the Parent Portal.

Data Privacy: You agree and acknowledge that in respect of any personal information you provide through the Parent Portal, in relation to yourself or your children: (i) SuperAwesome will process such data only in accordance with these Terms of Use, Applicable Law and any lawful written instructions you may reasonably give to SuperAwesome from time to time; (ii) SuperAwesome will have in place appropriate technical and organisational security measures against unauthorised or unlawful processing of such data and against accidental loss or destruction of, or damage to, such data; (iii) your data may be transferred or stored outside the EEA or the country where you are located in order to provide the Parent Portal.

You will have sole responsibility for the legality, reliability, integrity, accuracy and quality of the personal information you provide to SuperAwesome through the Parent Portal. SuperAwesome will not be responsible for any loss, destruction, alteration or disclosure of your data caused by any third party (except those third parties sub-contracted by SuperAwesome to perform services related to maintenance and back-up). SuperAwesome will, in providing the Parent Portal, comply with its Privacy Policy relating to the privacy and security of any data you provide.

Limitations of Liability:  THE SUPERAWESOME PARENT PORTAL IS PROVIDED “AS IS” AND SUPERAWESOME DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHER, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT AND WARRANTIES ARISING FROM COURSE OF DEALING, USAGE OR TRADE PRACTICE. SUPERAWESOME MAKES NO WARRANTY OF ANY KIND THAT THE PARENT PORTAL OR ANY PRODUCTS OR RESULTS OF THE USE THEREOF WILL MEET YOUR OR ANY OTHER PERSON’S REQUIREMENTS, OPERATE WITHOUT INTERRUPTION, ACHIEVE ANY INTENDED RESULT, BE COMPATIBLE OR WORK WITH ANY SOFTWARE, SYSTEM OR OTHER SERVICES OR BE SECURE, ACCURATE, COMPLETE, FREE OF HARMFUL CODE OR ERROR FREE. SUPERAWESOME OR ITS LICENSORS, WILL NOT BE LIABLE UNDER OR IN CONNECTION WITH THESE TERMS OR THEIR SUBJECT MATTER UNDER ANY LEGAL OR EQUITABLE THEORY, INCLUDING BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY AND OTHERWISE, FOR ANY LOSS OF REVENUE, PROFIT OR ANTICIPATED SAVINGS; BUSINESS INTERRUPTION OR IMPAIRMENT; OR ANY USE OF OR INABILITY TO USE KWS SELF-SERVE; LOSS, DAMAGE, CORRUPTION OR RECOVERY OF DATA; BREACH OF DATA OR SYSTEM SECURITY OR CONSEQUENTIAL, INCIDENTAL, INDIRECT, EXEMPLARY, SPECIAL, ENHANCED OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH USE OR ACCESS TO KWS SELF-SERVE, REGARDLESS OF WHETHER IT WAS ADVISED OF THE POSSIBILITY OF SUCH LOSSES OR DAMAGES OR SUCH LOSSES OR DAMAGES WERE OTHERWISE FORESEEABLE. IN NO EVENT WILL THE AGGREGATE LIABILITY OF SUPERAWESOME FOR CLAIMS ARISING UNDER OR IN CONNECTION WITH THIS AGREEMENT EXCEED £50 OR THE AMOUNT YOU PAID COMPANY UNDER THIS AGREEMENT (IF ANY).
